Two men arrested after sleeping in business

Two men were arrested Sunday morning after breaking into a business to find shelter for the night.

Tyler Police Sgt. Matt Leigeber said about 11:50 p.m. a caller notified the department something was strange at the Edward Jones Investment firm, 101 East Erwin St. Two men were asleep in the front part of the office.

According to police reports, two 28-year-old men broke through the front door and laid down for some shut eye. One allegedly was sleeping on the floor and another in a chair, but the pair was visible from the sidewalk.

According to reports, both men were heavily intoxicated.

“We don’t come across cases like this often,” Leigeber said. “It’s pretty unique to find someone who just wanted to pass out.”

Leigeber said nothing was reported stolen from the business, but there was damage to the front door.

He said it is unclear where the men came from, where they were headed or why they chose that particular spot.

“Drunk people will do strange things,” he joked.

Both were charged with public intoxication, a class C misdemeanor, and criminal trespassing, a class B misdemeanor.

The two were not charged with burglary of a building. Leigeber said for the crime to qualify for the charge, the two had to break in with the intent of committing a theft, assault or a felony.
