Upshur jury sentences man to nine years for assaulting public servant and retaliation

An Upshur County jury sentenced a Big Sandy man Tuesday to five years in prison for assault against a public servant and four years in prison for retaliation, according to a press release from Upshur County District Attorney Billy Byrd.

David Lee Mosley, 34, previously was sentenced to prison for possession of methamphetamine, the release stated. Both charges were third degree felonies, carrying a maximum sentence of 10 years in prison. The trial took place in the Upshur County 115th District Court.

Mosley was originally arrested on charges of assault/family violence, but deputies located multiple pills in his pocket, along with a glass pipe commonly used to smoke methamphetamine, according to the press release.

The defendant began to struggle with police and kicked a five gallon bucket, striking Deputy Scott Moore in the lower leg, the release stated. At the jail, Mosley continued his resistance and threatened vengeance against another police officer when Mosley was released from jail, the release stated.

Longview attorney Scott Novy represented the defendant. Byrd and Assistant District Attorneys Natalie Miller and Camille Henson prosecuted the case.
