UPDATE: Judge denies alcohol elections injunction

The judge denied the injunction. The opposition plans to file an election contest on Wednesday.

A visiting judge will hold a hearing at 4:30 p.m. today in Smith County court on the request for a temporary injunction. TylerPaper.com will post additional details as they become available.

A temporary injunction request has been filed in 7th District Court to prevent local option elections regarding alcohol from being enacted.

The lawsuit was filed against both the City of Tyler and Smith County by Delores Radford and Richard Lanham. The temporary injunction states that an independent review of the signature pages submitted "clearly show that placement of these propositions on the ballots is improper because the signature pages do not comtain the requisite amount of valid signatures of qualified voters." The suit claims that despite indications that petitions were not valid according to state law, the city and county approved the petitions for Nov. 6 ballots.

The 7th District Court has not scheduled a hearing yet.
