Ex-Cedar Creek official, Kile, pleads guilty to felonies

Jack Kile, the former manager of the West Cedar Creek Municipal Utility District that serves northwest Henderson County, recently pleaded guilty to seven felony counts of tampering with a governmental record, according to information from District Attorney Scott McKee.

Kile, 38, of Eustace, entered his plea in a Travis County District Court in Austin and was sentenced to three years deferred adjudication community supervision and ordered to pay a $2,500 fine, according to McKee. He was also required to complete a water utility management course.
The West Cedar Creek Municipal Utility District serves customers in Tool, Tolosa and Seven Points.
An investigation by the Texas Commission on Environmental Quality Crimes Unit determined that Kile submitted false surface wat-er monthly operating reports to the commission from June 2009 to January 2010, according to the information from McKee.
The falsified reports indicated that the turbidity in drinking water produced by the utility district was within acceptable limits when in fact the turbidity was too high, McKee said.
Turbidity is the cloudiness or haziness of a fluid caused by suspended solids that are generally invisible to the naked eye.
The case was prosecuted jointly by the Travis County District Attorney’s Environmental Protection Unit and McKee.
McKee was appointed by Travis County District Attorney Rosemary Lehmberg as a special prosecutor to assist in prosecuting the case.
McKee said, “Although the Travis County District Attorney’s Office has concurrent jurisdiction to prosecute these cases because the false reports were filed in Austin, I wanted to remain a part as a voice for the citizens of Henderson County.”
Kile has not been employed by the West Cedar Creek Municipal Utility District since March 2010.
