Man Convicted On Assault Charge

It took almost an hour Thursday for a Smith County jury in the 241st District Court to convict a Tyler man of head-butting and injuring an elderly business associate in August 2011.
Jose Duran Lara, 29, faces up to 10 years in prison when he is sentenced May 16 on a charge of injury to an elderly person.

It took almost an hour Thursday for a Smith County jury in the 241st District Court to convict a Tyler man of head-butting and injuring an elderly business associate in August 2011.
Jose Duran Lara, 29, faces up to 10 years in prison when he is sentenced May 16 on a charge of injury to an elderly person.
Visiting Judge Jerry Calhoon will sentence Lara, Smith County Assistant District Attorney Jason Parrish said. Calhoon is sitting in for Judge Jack Skeen Jr. while Skeen is involved in questioning prospective jurors for an upcoming capital murder trial.
Lara argued with the 72 year-old victim Aug. 10 at a tire store where the two worked. The victim’s brother owns the store, Parrish said. “The two had an altercation, and Lara grabbed the 72-year-old and head-butted him twice,” the prosecutor said.
The victim was transported to East Texas Medical Center, where he was treated and released on the same day, Parrish said. If someone aged 65 or older is assaulted, the person accused of the crime is charged with a felony, Parrish said.
Lara was convicted of theft, a state jail felony in February, Parrish said. Tyler defense attorney Bobby Mims represented Lara.
