Tyler Woman Indicted For Intoxicated Manslaughter
A 38-year-old Tyler woman remained in the Smith County Jail Wednesday after being indicted for intoxicated manslaughter.
Angela Kaye Daniels, 38, 3118 Lamont St., is charged with causing a fatality accident Oct. 25 that resulted in the death of Thomas O'Leary, 20, Whitehouse. Ms. Daniels was arrested Oct. 30 after officers received an anonymous tip and located her in an abandoned house on Texas Highway 155 South.
Ms. Daniels was indicted by a Smith County grand jury on Dec. 18. If convicted of the second-degree felony, she could face anywhere from two to 20 years in prison.
According to an arrest affidavit, Ms. Daniels was driving with a revoked license and had alcohol, methadone and amphetamines in her system at the time of the fatality collision.
Ms. Daniels was driving a 1992, black Chevrolet SUV when she allegedly ran a red light as she traveled southbound on Loop 323, entering the intersection of Old Henderson Highway. She allegedly struck a 200 Buell Motorcycle, driven by O'Leary, who was traveling east bound on Old Henderson Highway on a green light, reports show. Both drivers were taken to local hospitals and O'Leary died of his injuries.
The defendant's license had been revoked on July 10 due to a medical condition not disclosed, according to the affidavit. Blood was drawn from Ms. Daniels and showed the presence of alcohol, metha-done and amphetamines in her system, the affidavit states.
Smith County records show beginning in 1998, Ms. Daniels has been convicted of the misdemeanor offenses of driving while intoxicated, second offense, driving with license suspended, theft, possession of a controlled substance and possession of a dangerous drug. She was also convicted in 2005 of the state jail felony offense of possession of a controlled substance.
A Smith County grand jury in 114th District Judge Cynthia Stevens Kent's court handed up an additional 41 indictments Dec. 18. The true bills, released on Wednesday, include:
