Cannibalism Suspect Threatened Police Officer in Nov.

The man accused of murdering and then cooking parts of his dead girlfriend threatened a Tyler police officer with bodily harm after a short chase in November.

Don Martin, Tyler Police Department public information officer, told the Tyler Paper today that officers were dispatched on a suspicious person call in November to a parking lot at Broadway Square Mall.

  • When the officer arrived, Martin said the man driving a tan pickup sped out of the parking lot and took off.

    “The officer attempted to make a stop but he kept going,” Martin said.

    He said the officer was finally able to get Christopher Lee McCuin, 25, of Tyler to pull over, but the stop did not go smoothly.

    Martin said McCuin refused to follow directions and when the officer attempted to arrest him for driving while intoxicated and several outstanding warrants. McCuin then threatened to beat the officer, Martin said.

    “Then he spit in his face,” he said.

    McCuin was taken to jail where he spent four days before bonding out. His criminal history includes several counts of aggravated assault with a deadly weapon and multiple alcohol charges.

    He is once again behind bars, but this time McCuin is charged with the capital murder in connection with the death of his girlfriend Jana Shearer, 21, of Whitehouse.

    Smith County Sheriff officials have said they found evidence of possible cannibalism in the murder case.

    According to Smith County judicial records, McCuin has been in and out of the Smith County Jail numerous times since 2000.

    McCuin's first brush with law enforcement occurred in June 2000 when he was arrested for vulgar language in Whitehouse. Officers there cited McCuin with a long list of motor vehicle violations.

    Two months later, McCuin was arrested by Tyler police on the charge of driving while intoxicated.

    In October of 2000 he was arrested by Tyler city marshals for driving without a driver's license.

    The next time he was arrested was for a probation revocation for the DWI charge. McCuin was incarcerated from March until May of 2001 after his probation was revoked.

    Tyler police arrested him in September 2002 for public intoxication, but he was bailed out of jail within hours. Six days later, Whitehouse officers arrested him on "minor in possession of alcohol" charges.

    In February 2003 he was arrested on another alcohol-related charge and multiple motor vehicle citations.

    He stayed out of jail for two months before being arrested by Tyler police for "assault causes bodily injury" and public intoxication. In April 2003 McCuin was arrested on three counts of aggravated assault with a deadly weapon and a host of misdemeanor charges, including open alcoholic beverage in vehicle. He spent six months in jail before being released.

    Four years would go by before he was arrested again, but in November 2007 Tyler police attempted to stop McCuin for another DWI and he ran from officers. After his apprehension, he was charged with felony evading with a vehicle and obstruction/retaliation. He was released from the Smith County Jail four days later on bonds and fines totaling $9,000.

    McCuin would not be arrested again until he was taken into custody at his mother's home Saturday. He now sits in jail on a $2 million bond for the capital murder of his 21-year-old girlfriend.

    He is scheduled to be arraigned sometime Monday.
