Man Sentenced to One Year For Cemetery Vandalism
A 22-year-old Lindale man was sentenced to one year in jail Tuesday for vandalizing a Lindale cemetery on June 18.
David Charles Bitter, of Lindale, pleaded guilty to criminal mischief, a state jail felony, and was sentenced by 7th District Judge Kerry Russell to one year in a state jail facility and a $10,000 fine.
Bitter was arrested in June, along with Jeffery David James, 21, and Justin Hillard-Kennedy, 18, both of Lindale, for vandalizing the Lindale City Cemetery. Lindale also believed they were involved in the desecration of another local cemetery the week before.
About 40 headstones in the city cemetery had either been turned over or destroyed. At the Walnut Springs Community Cemetery, between 10 and 12 graves were desecrated.
Bitter was represented by Tonda Curry while assistant Smith County district attorneys Peter Keim and Amanda Dillon prosecuted the case.
James and Hillard-Kennedy have each pleaded guilty and await sentencing.
