Austin American-Statesman files lawsuit over city manager candidate secrecy

AUSTIN, Texas (AP) - An Austin newspaper has sued the city after officials denied disclosing the identities of finalists for city manager following a public records request.

The Austin American-Statesman filed the lawsuit Tuesday in Travis County District Court, seeking the disclosure of the candidates' names.

The city denied the newspaper's Texas Public Information Act request last week. The city wrote to the state attorney general that revealing the names would undermine the search for the best candidate.

Texas has laws protecting the identities of candidates for school superintendent or chief executive of a higher learning institution. But no such laws apply to government officials.

The city manager position has been vacant for more than a year since former City Manager Marc Ott left the position. Elaine Hart has filled in the role temporarily.
