A 9-year-old girl is dead and five other people are injured after their vehicle rolled over about 11:10 p.m. Friday on Texas Highway 31 near County Road 233.

John Harris Bates, 38 was driving westbound on Texas 31 in a SUV when he attempted to pass another vehicle by driving on the shoulder. DPS said, that’s when Bates lost control of the vehicle causing it to flip over and hit a tree ejecting the passengers.

Alexis Bates, 9, was pronounced dead on the scene. Bates was taken to East Texas Medical Center in critical condition. Aside from the girl and the driver, four other people were in the car at the time of the accident.

A 37-year-old woman was taken to ETMC, but was in stable condition Saturday afternoon. Two other children, ages 11 and 14, also were in stable condition at Trinity Mother Frances Hospital. An 11-month-old baby was care-flighted to Children’s Medical Hospital in Dallas. That baby also was listed in stable condition.

Investigators are still looking into what caused the accident. It’s not known if alcohol played a role in this accident.
