VIDEOS: Man taken into custody at Old Omen Road apartment complex; charged with overnight armed robbery

The woman inside her apartment at The Village Apartments on Old Omen Road Tuesday morning told police dispatchers via a 911 call that there was a man in her apartment she did not know.

Officer Doyle Lynch said as officers arrived they quickly set up a perimeter and began negotiations because the woman said she believed he might be the man police was looking for in connection with an earlier armed robbery. 

Her belief proved to be right, and after a short standoff with SWAT and negotiators, 19-year-old Jaylon Rutherford of Texarkana was taken into custody without incident. 

Rutherford is charged with the armed robbery of a gas station in the 4200 block of University Boulevard around 2 a.m. Tuesday. 

Once on scene of the robbery, officers learned that a man carrying a handgun went into the store and demanded money from the clerk.

But the man, later identified as Rutherford, left the scene, possibly driving a white Mercury Marquis. No one was hurt during the robbery.

Lynch said the woman awoke to find a man in her apartment and, after seeing media reports, told police she believed he was the man they wanted. 

The apartment complex is just a few blocks away from the scene of the robbery.

Rutherford was taken into custody on charges including, aggravated robbery, possession of a controlled substance in a drug free zone and possession of marijuana. 

He is being held in the Smith County Jail on bonds totaling $240,500.
